2025年4月23日,中国国家主席习近平同来华进行国事访问的阿塞拜疆总统阿利耶夫举行会谈,两国元首共同宣布建立中阿全面战略伙伴关系,并签署《中华人民共和国和阿塞拜疆共和国关于建立全面战略伙伴关系的联合声明》。随着“一带一路”倡议的深入推进,阿塞拜疆凭借其优越的地理位置、税收减免政策及日益开放的营商环境,正吸引越来越多中国企业前往投资兴业。劳动用工合规是企业海外经营的核心环节之一,涉及劳动合同、薪酬福利、工时休假、社会保险等多方面法律要求。本文结合阿塞拜疆最新劳动法规与实践,梳理当地雇佣员工的合规要点,旨在帮助赴阿投资企业规避风险,实现安全、合规、可持续的经营发展。1
一、劳动合同与入职合规
(一)劳动合同的签订
Labor Code of the Republic of Azerbaijan(以下中文称“《阿塞拜疆劳动法》”)第7条第2款规定,劳动关系自以电子文件形式在电子信息系统中签订劳动合同之日起成立,但仍有两项例外:(1)在相关执行权力机关批准的清单上的国家机构中,被录用(担任)相应职位(职业)的雇主与雇员之间的劳动关系,在以书面形式订立劳动合同时建立;(2)根据阿塞拜疆共和国《法人和国家登记法》,对于在本地投资的有限责任公司电子注册申请中指明的人员,其劳动关系自该法规定的方式将注册证书、国家登记摘录和公司章程发送至公司电子账户之时起成立。2
《阿塞拜疆劳动法》第12条第1款h项3规定,在劳动关系以在电子信息系统中签订劳动合同之日为成立标志时,雇主的主要义务包括将雇佣合同通知录入电子信息系统中,并使用电子签名进行签署;但是(本法第7条第2款第1项和第2款第2项规定的情形除外)。
因此,除少数特别情况外,雇主需要在官方电子信息系统中签署与员工的雇佣合同,劳动合同方才成立。如果雇主违反关于雇佣合同订立的义务,则根据《阿塞拜疆劳动法》第311条4和第186条第1款和第4款5,应当承担纪律责任(disciplinary liability)以及刑事与行政责任。例如,The Code of the Azerbaijan Republic On administrative violations(以下中文称“《阿塞拜疆行政处罚法》”)第53条第1款6规定,雇主未按阿塞拜疆共和国《劳动法》规定的方式签订雇佣协议(合同)而招用自然人完成任何工作(服务)的,应对政府雇主处以3,000-5,000AZN(约为人民币12,510-20,850元)、对法人实体雇主处以20000-25000AZN(约为人民币83,400-104,250元)的罚款。
(二)试用期的规定
试用期期间
根据《阿塞拜疆劳动法》第51条,劳动合同可以约定试用期以检查雇员的专业水平和履职能力,但是应当明确约定试用期,且为期不超过六个月的劳动合同,试用期不得超过两周,为期超过六个月的劳动合同,试用期则不得超过三个月。另外,雇员暂时丧失工作能力或未出勤但保留平均工资的期间,不得计入试用期。7
不得设置试用期的特殊情形
《阿塞拜疆劳动法》第52条8进一步规定了不得为以下人员设置试用期:
(1)未满 18 岁的人员
(2)通过获得相关职位的人员
(3)孕妇及有三岁以下子女的妇女,以及单独抚养三岁以下子女的男子
(3)在毕业当年首次按其专业(职业)就业的人员
(4)被选任到有薪酬的选举职位的人员
(5)合同期限不超过 2 个月的人员
(6)双方协议确定的其他情况
试用期考核及合同终止
《阿塞拜疆劳动法》第53条9规定了试用期与劳动合同终止的规则。
1. 试用期结束前终止:任何一方可提前 3 天书面通知对方(纸质或通过电子信息系统)终止雇佣合同。
2. 试用期结束后提出终止:若双方在试用期结束前均未提出终止合同,则员工视为顺利通过试用期,此后雇佣合同只能依据《阿塞拜疆劳动法》规定的程序和理由终止。
3. 试用期表现不合格: 雇主应在劳动合同中明确说明员工试用期表现不合格时终止合同的条件,而对于在试用期内未证明其胜任能力的雇员,其劳动合同可凭雇主出具的说明理由的书面指令予以终止。
二、工资
(一)最低工资
最低工资标准
自2025年1月1日起 400 AZN/月(约为人民币1,668元),全国统一。
工资构成
《阿塞拜疆劳动法》第155条第5款规定,奖金、工资津贴、增补额,以及在正常工作时间之外完成工作的报酬,和工资制度规定的其他付款,不包含在最低工资的数额内。10
违反最低工资的处罚
根据《阿塞拜疆行政处罚法》第53条第3款,雇主向员工支付低于法律规定最低工资标准的工资的,应处以1,000-1,500AZN(约为人民币4,170-6,255元)的罚款。11
(二)加班工资的支付标准
根据《阿塞拜疆劳动法》第165条12,对于加班期间完成的每小时工作,应向雇员支付工资,标准如下:
在计时工资制下,支付不低于小时工资(职务工资)标准两倍的报酬;
在计件工资制下,全额支付计件工资,并额外支付一笔附加报酬,其费率不低于具备相应资格(专业)的非全日制雇员的小时工资(职务工资)标准。
另外,禁止雇主以额外休息日来代替支付加班工资。
(三)特殊节日的工资支付标准:
根据《阿塞拜疆劳动法》第164条13,对于休息日、节假日、投票日、公众哀悼日(每年的1 月 20 日——纪念为阿塞拜疆独立和领土完整而牺牲的烈士的日子——是全国哀悼日)的每一小时工作,其工资应按下述规定支付:
在计时工资制下,支付不低于日工资标准两倍的报酬;
在计件工资制下,支付不低于工资标准两倍的报酬;
对于领取月薪的员工,若工作在月正常工作时间内完成,除月薪外,须额外支付不低于其日职务工资额的报酬;若工作在月正常工作时间之外完成,除月薪外,须额外支付不低于其日职务工资额两倍的报酬。
此外,在休息日、投票日、节假日和公众哀悼日工作的雇员可以申请额外休息一天,以代替上述工资。
(四)工资发放频率
《阿塞拜疆劳动法》第172条第1款、第2款、第3款14规定,雇员的月工资原则上应分两次(预付和剩余部分)支付,每月两次且间隔不得超过十六天,雇员的年工资每月应支付不少于一次,工资支付的其他周期可通过集体协议或劳动合同确定;如果工资支付日适逢休息日、投票日、国丧日或不视为工作日的假日,则应于该日之前的工作日支付。
(五)处罚
工资延迟支付处罚
《阿塞拜疆劳动法》第172条第5款15规定,若因雇主过错导致工资支付延迟,且此情况已引发个体劳动争议,则应为雇员支付补偿金,其数额为每延迟一日,按未支付工资的至少百分之一计算。
《阿塞拜疆劳动法》第172条第6款16规定,若因雇主过错17,未能在本法典第83条第3款第二部分规定的期限内发出雇员的工作记录簿,则应向该雇员支付其无法找到工作的整个期间的平均工资。
未足额支付工资、基本工资的处罚:
(1)补发欠款;
(2)赔偿因此产生的额外损失(如利息、合理费用等);
(3)根据《阿塞拜疆行政处罚法》第53条第4款18,在计算和支付员工工资及休假工资时(因数学计算错误导致的短缺除外)出现违法行为的,将对单位负责人处以 700–1,500 ANZ罚款(约为人民币约为人民币2,919-6,255元)。19
三、工时、加班
(一)工时相关规定
标准工时
根据《阿塞拜疆劳动法》第89条20和第90条第1款21,原则上通常实行 5 天工作制,每周休息 2 天,正常每日工作时间不得超过 8 小时,每周不超过40小时。
特殊工种可实行6天工作制22
根据《阿塞拜疆劳动法》第90条第2款和第3款,根据生产、工作、服务的性质和工作条件,雇主在相关行政部门批准后,可实行 6 天工作制,此时:
若每周工作时长为 40 小时,每日工作时间不得超过 7 小时;
若每周工作时长为 36 小时,每日工作时间不得超过 6 小时;
若每周工作时长为 24 小时,每日工作时间不得超过 4 小时。
特殊岗位和人群的工时限制
《阿塞拜疆劳动法》第91条23规定,雇主可根据本法典及相关规范性法律文件,以及劳动合同和集体协议的条款,综合考虑其年龄、健康状况、工作条件、工作职能特点及其他情况,为特定类别雇员设立缩短工时。但是第91条、第92条、第94条也对缩短后的工作时间作出以下限制:
(1)16岁以下员工每周工作时间不得超过 24 小时;
(2)16-18岁员工、残疾员工(身体功能受损 61-100% )、孕妇以及育有18岁以下子女或抚养3岁以下子女的父母,每周工作时间不得超过 36 小时;24
(3)从事有害工作条件的员工,每周工作时间不得超过 36 小时;
(4)涉及高灵敏度、兴奋、精神、身体或神经紧张等工作条件的岗位(一般是指在法律规定的电工安装、设备及其他工作场所工作的医生、教师)25每周工作时间不得超过 36 小时。26
夜间工作
《阿塞拜疆劳动法》第97条27、第98条28明确了夜间工作的认定标准以及工作时间等限制。
(1)夜间工作时间:晚上 22:00 至 6:00 之间;对于在相关执行权力机构确定的具有不同等级有害工作条件的工作场所工作的员工,以及从事连续性工作的员工,若其日工作时间至少有一半落在夜间,则落在夜间的这部分工作时间应缩短一小时。
(2)禁止安排在夜间工作的雇员
①禁止雇佣十八岁以下的工人进行夜间工作;
②残疾工人仅在征得其本人书面同意,并考虑相关执行权力机构指定的机构(单位)的意见后,方可被安排从事夜间工作;
③孕妇、有14岁以下子女的妇女、有残疾子女的妇女(需考虑本法典第242条规定)、以及在没有母亲的情况下抚养三岁以下子女的男子仅在征得其本人书面同意后,方可被安排从事夜间工作。
(二)加班相关规定
根据《阿塞拜疆劳动法》第99条第1款,加班工作是指根据雇主的要求(命令、决定)并经雇员同意,在既定工作日之外履行劳动职能。29
允许加班工作的情况
《阿塞拜疆劳动法》第99条第2款规定,为防止自然灾害、生产事故和其他紧急情况、消除其后果、保障军事管制以及防止在途货物损失,允许安排雇员加班工作,但须遵守本法典规定的规则。30《阿塞拜疆劳动法》第101条31进一步规定了允许加班的特殊情况并规定雇主有义务采取一切必要措施,安排其他雇员顶替缺席雇员,并迅速消除导致在本条规定的特殊情况下安排雇员加班的原因:
(1)执行保障国家防务所需的最重要工作,以及预防自然灾害、生产事故或消除其后果;
(2)为确保执行必要工作,以消除导致供水和供电、燃气、供暖、通讯及其他公用设施工作中断的意外故障的后果;
(3)已开始的工作因生产技术条件无法在工作日结束时完成,且因设备或货物面临迫在眉睫的损坏或毁坏危险而必须在同一天完成该工作;
(4)当有必要执行与修理或恢复故障机械和装置相关的工作,且该故障导致大多数雇员的工作中断时;
(5)因顶替雇员缺席而无法允许工作中断时。
禁止安排加班的雇员
(1)《阿塞拜疆劳动法》第99条第3款规定,禁止安排在特别艰苦和有害区域工作的雇员等进行加班工作;32
(2)《阿塞拜疆劳动法》第242条对安排女性从事夜间工作、加班工作、周末工作以及出差的限制:孕妇、有(包括收养)14岁以下子女的妇女以及有(包括收养)残疾子女的妇女,仅在征得其本人书面同意后,方可被安排从事夜间工作、加班、在周末、假日及其他非工作日工作以及被派出差(对于孕妇和有3岁以下子女的妇女,还需有医生出具的意见,表明对其生命或健康或其子女无危险)。33
加班时限
《阿塞拜疆劳动法》第100条规定,任何雇员在连续两个工作日内被安排加班的时间不得超过四小时,而在艰苦和有害工作条件的工作场所,不得超过两小时。34
加班薪酬
《阿塞拜疆劳动法》第165条35规定,不得用补休代替加班工资,且加班工资显著高于正常工资,其标准如下:
(1)在计时工资制下,支付不低于小时工资(职务工资)标准2倍的报酬;
(2)在计件工资制下,全额支付计件工资,并额外支付一笔附加报酬,其费率不低于具备相应资格(专业)的非全日制雇员的小时工资(职务工资)标准
(三)违反工时和加班的后果
根据《阿塞拜疆行政处罚法》第54条第5项,违反劳动保护规则(包括但不限于不遵守正常的劳动和休息制度)的雇主将被处以1000-2000AZN(约为人民币4,170-8,340元)的罚款。36
四、强制缴纳的三类社会保险
《阿塞拜疆劳动法》第304条第2款规定,与雇员签订劳动合同时,雇主必须确保根据阿塞拜疆共和国《社会保险法》规定的程序,为每位雇员办理强制性国家社会保险37;第307-1条规定,雇主必须根据阿塞拜疆共和国《医疗保险法》规定的程序,为每位雇员办理强制医疗保险。劳动合同必须包含关于雇员强制医疗保险的相关信息38。
(一)强制性社会保险
雇主:200 AZN(约为人民币834元)以内:22%; 超过200 AZN部分:15%+44 AZN(约为人民币183.48元)。
雇员:200 AZN(约为人民币834元)以内:3% ; 超过200 AZN部分:10%+6AZN(约为人民币25.02元)。
(二)失业保险
雇主 0.5%,雇员 0.5%。
(三)强制性医疗保险(CHI)
雇主:≤8,000 AZN(约为人民币33,360元)部分:1%;>8,000部分:0.5%+160AZN(约为人民币667.20元);
雇员:≤8,000 AZN(约为人民币33,360元)部分:1%;>8,000部分:0.5%%+160AZN(约为人民币667.20元)。
五、违反劳动法可能面临的其他处罚——刑事责任
对于情节严重、性质恶劣的违法行为,如恶意违反劳动保护标准、重侵犯员工和雇主的合法权益等,雇主将面临刑事起诉,并依据《阿塞拜疆刑法典》第162条、承担相应刑事责任39。
综上所述,阿塞拜疆劳动用工合规涉及劳动合同、工资支付、工时休假、社会保险及法律责任等多方面内容。企业需密切关注当地法规动态(如2025年最低工资标准调整、节假日调休安排),并严格履行雇主义务,避免因违规行为面临罚款或法律纠纷。在中阿全面战略伙伴关系背景下,中国企业赴阿投资迎来新机遇,唯有深耕合规管理、尊重本地文化、保障员工权益,方能真正“走出去”“走进去”“走长远”,实现两国经贸合作的互利共赢。

Labor Code of the Republic of Azerbaijan Article 7. Regulation of labor relations by legislation and by concluding contracts
2. Except for the cases specified in Parts 2-1 and 2-2 of Article 7 of this Code, labor relations arise when an employment contract is concluded in the form of an electronic document in an electronic information system.
2-1. Labor relations between employees accepted (recruited) to relevant positions (professions) in state bodies (or organizations), the list of which is approved by the relevant executive authority, and employers arise when an employment contract is concluded in written form on paper.
2-2. In accordance with the Law of the Republic of Azerbaijan “On State Registration of Legal Entities and the State Register”, employment relations with the persons specified in the application for electronic registration of a limited liability company with local investment [14], arise from the moment the certificate of registration, extract from the state register and charter are sent to the company's electronic cabinet in the manner prescribed by that Law.
Labor Code of the Republic of Azerbaijan Article 12. Main duties and responsibilities of the employer
1. The main duties of the employer in the field of labor relations are:
h) enter the employment contract notification into the electronic information system using an electronic signature (except for the cases specified in parts 2-1 and 2-2 of Article 7 of this Code);
Labor Code of the Republic of Azerbaijan Article 311. Disciplinary liability for violation of labor legislation
If an employee or employer violates their obligations established by the employment contract, labor function, as well as the requirements of this Code and other normative legal acts included in the labor legislation system, thereby causing certain damage to the rights and legally protected interests of the other, they shall be subject to disciplinary liability as provided for in Article 186 of this Code.
Labor Code of the Republic of Azerbaijan Article 186. Disciplinary liability for violation of labor and executive discipline and its types
1. If an employer or employee fails to fulfill their duties established by this Code and other regulatory legal acts, or abuses their rights, or fails to fulfill their obligations under an employment contract, they shall be subject to disciplinary liability, and in cases provided for by legislation, also to material liability.
4. The employer shall be held liable for disciplinary action as provided for in this Article by an official considered to be his employer, the owner of the enterprise, or, if the enterprise is state-owned, by the relevant executive authority. The employer shall be held liable for administrative or criminal offense in accordance with the procedure established by law.
The Code of the Azerbaijan Republic On administrative violations Article 53. Violation of the labor legislation
53.1. Attraction of natural person to fulfillment of any works (services) by employers
without entering to the employment agreement (contract) in an order stipulated by the
Labor Code of the Azerbaijan Republic, —
§ shall involve penalization on officials at the rate of three thousand to five
thousand, on legal entities - twenty thousand to twenty five thousand manats.
Labor Code of the Republic of Azerbaijan Article 51. Probationary period
1. Except for the cases specified in Article 52 of this Code, an employment contract may be concluded with a probationary period for the purpose of checking the employee's professional level and ability to perform the labor function. A probationary period of no more than two weeks shall be established in an employment contract concluded for a period of up to six months, and a probationary period of no more than three months shall be established in other employment contracts.
2. The probationary period consists of the working hours during which the employee performs his/her labor function. Periods during which the employee temporarily loses his/her ability to work, as well as periods during which he/she is absent from work while maintaining his/her average salary, are not included in the probationary period.
3. An employment contract that does not specify a probationary period is considered to have been concluded without a probationary period.
Labor Code of the Republic of Azerbaijan Article 52. Cases where a probationary period is not determined
A probationary period when concluding an employment contract is not established:
with persons under the age of 18;
with those who hold the relevant position through competition;
with pregnant women and women with children under the age of three, as well as with men raising children under the age of three alone;
with persons who are employed for the first time in their specialty (profession) in the year they graduate from educational institutions;
with persons elected to a paid elective office;
with persons with an employment contract for a period of up to two months;
in other cases determined by agreement of the parties.
Labor Code of the Republic of Azerbaijan Article 53. The result of the test during employment and the procedure for its regulation
1. Before the end of the probationary period, either party may terminate the employment contract by giving the other party three days' written notice (on paper or via an electronic information system).
2. If one of the parties has not requested the termination of the employment contract by the end of the probationary period, the employee shall be deemed to have completed the probationary period successfully. From the moment the employee is deemed to have completed the probationary period, the employment contract may be terminated only in accordance with the procedure and on the grounds established by this Code.
3. When determining the probationary period in an employment contract, the employer must specify the condition for terminating the employment contract if the employee fails to perform satisfactorily during the probationary period.
4. The employment contract of an employee who has not proven himself during the probationary period may be terminated by a reasoned order of the employer. The employee must be informed in writing of the reasons for such termination.
Labor Code of the Republic of Azerbaijan Article 155. Minimum wage
5. Bonuses, wage supplements, increases, as well as payments for work performed outside normal working hours and other payments provided for by the wage system are not included in the amount of the minimum wage.
The Code of the Azerbaijan Republic On administrative violations Article 53. Violation of the labor legislation
53.3. Payment of the salary to the employee in the amount less than minimal salary
stipulated by the legislation —
§ shall involve penalization at the rate of one thousand to one thousand five hundred
manats.
Labor Code of the Republic of Azerbaijan Article 165. Payment of wages for work performed overtime
1. Employees shall be paid wages for each hour of work performed during overtime as follows:
not less than double the hourly rate (position) salary in the time-based wage system;
In the piecework payment system, the piecework wage is paid in full, plus an additional payment at a rate not lower than the hourly rate (position) salary of a part-time employee of the appropriate qualification (specialized).
2. The employment contract or collective agreement may provide for the payment of a higher amount of additional remuneration to employees for work performed overtime.
3. Replacing overtime with an additional day off is not allowed.
Labor Code of the Republic of Azerbaijan Article 164. Payment of wages for work performed on days off, voting days, holidays that are not considered working days, and national mourning days
1. Wages for work performed on days off, voting days, holidays that are not considered working days, and national mourning days shall be paid as follows:
not less than twice the daily rate of pay in the time-based wage system;
not lower than double the wage rates in the piece-rate wage payment system;
For employees receiving a monthly salary, if the work was done within the monthly working time norm, in addition to the salary, not less than the amount of the daily duty salary; if the work was done outside the monthly working time norm, in addition to the salary, not less than the double amount of the daily duty salary.
2. At the request of an employee who has worked on a day off, voting day, non-working holiday, or national day of mourning, he or she may be granted another day off instead of salary payment.
Labor Code of the Republic of Azerbaijan Article 172. Periods for payment of wages
1. Monthly wages shall be paid to employees, as a rule, in two installments (in advance and in the amount of the remaining amount) twice a month with an interval of not more than sixteen days. Employees whose wages are calculated for an annual period shall be paid no less than once a month.
2. Other periods for payment of wages may be determined in a collective agreement or employment contract.
3. If the day on which wages are paid falls on a day off, a voting day, a national day of mourning, or a holiday that is not considered a working day, it shall be paid on the day immediately preceding such day.
Labor Code of the Republic of Azerbaijan Article 172. Periods for payment of wages
5. If the payment of wages is delayed due to the fault of the employer and this circumstance has given rise to an individual labor dispute, the employee shall be paid compensation in the amount of not less than one percent of the unpaid wages for each delayed day. If this circumstance gives rise to a collective labor dispute, the dispute shall be resolved in accordance with the procedure provided for in the section "Labor Disputes" of this Code.
Labor Code of the Republic of Azerbaijan Article 172. Periods for payment of wages
6. If the issuance of an employee's work record book within the time specified in the second part of Part 3 of Article 83 of this Code is delayed due to the fault of the employer, the employee shall be paid the average wage for the entire period during which he/she was unable to find work.
“因雇主过错导致的延迟”是指因未在规定时间内核算工资、未从授权银行收到款项、未按时进行财务和会计操作,以及其他直接取决于雇主意愿和能力的情况,而导致未能在规定期限内向雇员支付工资。此术语不适用于因雇主无法控制的情况而导致其未能按时支付工资的情形,例如银行违反立法要求的不当金融操作、银行破产,以及因另一雇主未支付已完成的工作或已提供的服务款项。
The Code of the Azerbaijan Republic On administrative violations Article 53. Violation of the labor legislation 53.4. Allowance of violations of the Law in the calculation and payment of salary and vacation pay of the employee, except for shortages admitted as a result of mathematical calculations, shall involve penalization on officials at the rate of seven hundred to one thousand five hundred manats.

4. Allowance of violations of the Law in the calculation and payment of salary and vacation pay of the employee, except for shortages admitted as a result of mathematical calculations, shall involve penalization on officials at the rate of seven hundred to one thousand five hundred manats.
Labor Code of the Republic of Azerbaijan Article 89. Full-time work and its duration
1. Full-time work is the time determined for employees to perform their labor functions within the weekly and daily working hours provided for in this Code.
2. The duration of normal daily working hours may not exceed eight hours.
3. The duration of the normal weekly working time corresponding to the normal daily working time cannot be determined to exceed 40 hours.
Labor Code of the Republic of Azerbaijan Article 90. Determination of full weekly working hours
1. As a rule, a five-day work week with two days off is established.

2. Depending on the nature of production, work, service and working conditions, the employer with the relevant executive authority may establish a six-day working week within the framework of the full-time weekly working time.
3. In a six-day work week, if the weekly norm is 40 hours, the duration of daily working hours cannot exceed 7 hours, if the weekly norm is 36 hours, the duration of daily working hours cannot exceed 6 hours, and if the weekly norm is 24 hours, the duration of daily working hours cannot exceed 4 hours.
Labor Code of the Republic of Azerbaijan Article 91. Short-time work
1. Shortened working hours may be established for individual categories of employees, taking into account their age, health, working conditions, characteristics of their work function and other circumstances, in accordance with this Code and relevant regulatory legal acts, as well as the terms of the employment contract and collective agreement.
2. The duration of reduced working hours shall not exceed 24 hours per week for employees under the age of 16, and 36 hours for employees aged 16 to 18 and employees with a disability of 61-100 percent of bodily functions, as well as pregnant women and women with children under the age of 18 and parents raising children under the age of 3.
Labor Code of the Republic of Azerbaijan Article 92. Reduced working hours for employees engaged in work with harmful conditions
1. Employees working in industries, professions and positions with physical, chemical, biological and other severe production factors harmful to human health shall be assigned a reduced working week of no more than 36 hours per week.

Labor Code of the Republic of Azerbaijan Article 93. Shortened working hours for employees engaged in special jobs
In workplaces with labor conditions that involve high sensitivity, excitement, mental, physical or nervous tension, as well as other factors that negatively affect human health (for doctors, teachers working in electrotechnical installations, devices and other workplaces provided for by law), shortened working hours are established, provided that they do not exceed 36 hours per week.
Labor Code of the Republic of Azerbaijan Article 97. Duration of work performed at night
1. The period from 10 p.m. to 6 a.m. is considered night time.
2. When at least half of the daily working hours of employees working in workplaces with different levels of harmful working conditions, as determined by the relevant executive authority, as well as in work of a continuous nature, fall at night, the part of the working hours falling at night shall be shortened by one hour.
Article 98. Employees who are not allowed to be involved in night work
1. It is not permitted to employ workers under the age of eighteen for night work.
2. Disabled workers may be involved in night work only with their written consent and taking into account the opinion of the body (institution) designated by the relevant executive authority.
3. Pregnant women, women with children under the age of 14, as well as women with children with disabilities (taking into account Article 242 of this Code), and men raising children under the age of three without a mother may be involved in night work only with their written consent.

1. Overtime work is considered to be the performance of a labor function beyond the established working day, upon the order (order, decision) of the employer and with the consent of the employee.

2. In order to prevent natural disasters, industrial accidents and other emergencies, eliminate their consequences, ensure martial law, as well as prevent the loss of goods in transit, it is permitted to involve an employee in overtime work, subject to compliance with the rules established by this Code.
Labor Code of the Republic of Azerbaijan Article 101. Exceptional circumstances in which overtime work is permitted
1. Overtime work is permitted only in the following exceptional cases:
a) to carry out the most important work necessary to ensure the defense of the state, as well as to prevent natural disasters, industrial accidents or eliminate their consequences;
b) to ensure that necessary work is carried out to eliminate the consequences of unexpected disruptions that lead to disruption of work and services in water, gas and electricity supply, heating, communications and other utility facilities;
c) suspension of work that has been started and cannot be completed by the end of the working day due to technical conditions of production, when it is necessary to complete the work in the same day due to an imminent danger of equipment or goods being damaged or broken;
d) when it is necessary to carry out work related to the repair or restoration of malfunctioning mechanisms and devices, which causes the suspension of the work of the majority of employees;
e) when it is impossible to allow a break in work due to the absence of the replacement employee.
2. The employer is obliged to take all necessary measures to replace an absent employee with another employee, as well as to promptly eliminate the reasons that led to the involvement of employees in overtime work in exceptional cases provided for in this article.

3. It is not allowed to involve employees working in especially difficult and harmful areas, as well as other cases provided for in this Code, in working overtime.
Labor Code of the Republic of Azerbaijan Article 242. Restrictions on women's involvement in night work, overtime work, work on weekends, as well as on business trips
1. Pregnant women, women with children under 14 years of age, as well as women with disabled children, may be employed at night, work overtime, on weekends, holidays and other days that are not considered working days, and sent on business trips only with their written consent (in the case of pregnant women and women with children under 3 years of age, if there is a doctor's opinion that there is no danger to their life or health, or the child's).
2. Part 1 of this article shall also apply to women who adopt a child under the age of 14, as well as women who adopt a child with a disability.

1. Each employee may not be involved in overtime work for more than four hours during four consecutive working days, and in workplaces with difficult and harmful working conditions, not more than two hours.

1. Employees shall be paid wages for each hour of work performed during overtime as follows: not less than double the hourly rate (position) salary in the time-based wage system; In the piecework payment system, the piecework wage is paid in full, plus an additional amount not lower than the hourly rate (position) salary of a part-time employee of the appropriate specialty (specialized).
2. The employment contract or collective agreement may provide for the payment of a higher amount of additional remuneration to employees for work performed overtime.
3. Replacing overtime with an additional day off is not allowed.

54.0. Violation of the rules of labour protection, i.e.:
54.0.5. non-observance of normal regime for labour and rest;
shall involve penalization at the rate of one thousand to two thousand manats.
Labor Code of the Republic of Azerbaijan Article 304. Social insurance of employees
When concluding an employment contract with an employee, the employer must ensure that each employee is covered by compulsory state social insurance in accordance with the procedure established by the Law of the Republic of Azerbaijan “On Social Insurance”. The employment contract must necessarily contain relevant information on the employee’s compulsory state social insurance, including whether he or she is covered by additional insurance.

The employer must ensure compulsory medical insurance for each employee in accordance with the procedure established by the Law of the Republic of Azerbaijan “On Medical Insurance”. The employment contract must necessarily contain relevant information about the employee’s compulsory medical insurance.
Criminal Code of the Republic of Azerbaijan Article 162. Infringement of a labor safety rules
162.1. Infringement of safety precautions regulations or other rules of labor safeties committed by a person, to whom these rules are assigned, and as result brought to serious or minor serious harm to health of a person— is punishable by the penalty at a rate from two thousand to three thousand manats, or corrective works for the term up to two years, or restraint of freedom(see) for the term up to one year, or imprisonment for the term about six months.
162.2. The same action, which on imprudence brought to death of a person— is punishable by imprisonment for the term up to five years with deprivation of the right to hold the certain posts or to engage in the certain activities for the term up to three years or without it.
162.3. Acts provided for in Article 162.1 of this Code, which caused by negligence the death of two or more persons— is punishable by imprisonment for the term from three to seven years with deprivation of the right to hold the certain posts or to engage in the certain activities for the term up to three years or without it.
